In day-to-day business operations, it is generally rare to conduct communications within the company or with counterparties through e-mails or written documents in anticipation of future disputes. However, when a dispute arises with a counterparty and the dispute is referred to arbitration, employee communications may be submitted as important evidence in the proceedings, whether in favor of your company or against it. However, there are some measures which permit a party not to disclose certain documents, and by strategically managing your documents on a daily basis, a party can increase its chances of protecting highly confidential or business-sensitive information from disclosure. Moreover, it has been observed that document production is one of the most time-consuming and expensive aspects of international arbitration proceedings. In this respect, proper daily document management systems can help save the company time and money in the document production process, and achieve a speedy and efficient international arbitration process overall.
This seminar is designed to provide employees who are in charge of contract management and in-house counsel with practical tips on how to strategically manage documents on a day-to-day basis in preparation for future disputes. The panelists will discuss the main disclosure procedures in international arbitration and what steps can taken on a day-to-day level to ensure an expeditiously and efficient process from common law and civil law perspectives. The panelists will provide practical insights based on their experiences as party representatives, arbitrators, and mediators.
